These Learner Terms and Conditions apply to all learners who book, register for, attend or access training delivered by Clarivive MedInsight Ltd. They apply to: • Online self-paced learning • Live webinars and virtual training • Face-to-face training • In-house employer training • Blended learning • Any associated assessment, certification or learner-support service By booking, registering, attending or accessing training, the learner confirms that they have read and agree to these terms and any course-specific requirements that were made available before enrolment. Where an employer or organisation makes a booking on behalf of a learner, the learner must still comply with the requirements relating to participation, conduct, assessment, account security and certification. Nothing in these terms removes any statutory consumer right that cannot legally be excluded.
These terms explain the conditions under which Clarivive MedInsight Ltd provides training services and the responsibilities that apply to learners.
They cover:

Learners should read these terms before making a booking or starting a course.
Additional conditions may apply to a specific course, qualification, accreditation, employer booking or practical assessment. Where additional conditions apply, they will be communicated before or during registration where reasonably possible.
Learners are responsible for checking that a course is suitable for their needs before booking or beginning training.
Where a course has entry requirements, learners must meet those requirements. These may include:
• Minimum age
• Previous training or qualifications
• Relevant work experience
• Professional registration
• English-language ability
• Physical participation requirements
• Employer approval
• Completion of prerequisite learning
• Access to suitable equipment or technology
Learners must provide accurate and complete information about their eligibility where requested.
Clarivive MedInsight Ltd may refuse, delay or cancel enrolment where:
• Entry requirements have not been met
• Required evidence has not been provided
• Information supplied appears inaccurate or misleading
• The course is unsuitable for the learner’s stated role or requirements
• Participation would create an unreasonable health or safety risk
• The learner does not have appropriate employer or organisational authority where this is required
Where enrolment is refused, any refund entitlement will be considered under the applicable booking and refund terms.
Learners remain responsible for checking whether a course meets the requirements of their employer, professional regulator, commissioning organisation or workplace.
Learners must register using their correct legal or professional name where this will appear on training records or certificates.
Registration information must be accurate, complete and kept up to date. This includes:
• Full name
• Email address
• Contact information
• Employer or organisation details where relevant
• Job role where requested
• Any information needed to determine course eligibility
• Information needed to provide agreed support or adjustments
Learners must:
• Use only their own learner account
• Keep login details and passwords confidential
• Take reasonable steps to prevent unauthorised account access
• Notify us promptly if they suspect that their account has been compromised
• Check that their personal details are correct before certificate generation
• Use a personal or work email address that they can access reliably
Learners must not:
• Share their account or password
• Allow another person to complete training or assessment on their behalf
• Access another learner’s account
• Register using false, incomplete or misleading information
• Create duplicate accounts to obtain additional attempts, certificates or access
• Circumvent LMS restrictions or course controls
Activity completed through a learner’s account may be treated as activity undertaken by that learner unless there is evidence of unauthorised use.
Training may be delivered through:
• Our Learning Management System
• A webinar or virtual meeting platform
• A Clarivive MedInsight training venue
• An employer or client location
• A third-party venue
• A blended combination of online and practical learning
Course information will normally explain the expected delivery method, duration, requirements and assessment arrangements.
Clarivive MedInsight Ltd may make reasonable changes to:
• Course dates or times
• Trainers
• Venues
• Webinar platforms
• Course sequence
• Learning activities
• Supporting resources
• Delivery methods
Changes may be necessary because of trainer availability, venue disruption, technology failure, safety concerns, low enrolment, severe weather, public-health requirements or circumstances outside our reasonable control.
Where a material change affects a confirmed booking, we will take reasonable steps to notify the learner or booking organisation and provide an appropriate alternative, rescheduling arrangement, credit or refund where required under the applicable policy and law.
We do not guarantee that every course will remain continuously available or that every advertised course date will proceed.
Our training supports awareness, knowledge, professional development and, where specifically included, practical skill development.
Training may include:
• Theory instruction
• Case studies
• Demonstrations
• Simulated practice
• Group discussion
• Knowledge assessment
• Practical assessment
• Feedback and reflection
Completion of training does not automatically provide:
• Professional registration
• A statutory licence
• Employment
• Permission to perform a regulated activity
• Authority to work outside the learner’s role or scope of practice
• Employer competency sign-off
• Clinical or workplace authorisation
• Permission to practise independently
• Fitness-to-practise confirmation
• Replacement for workplace induction
• Replacement for local policies, supervision or risk assessment
Practical training completed in a classroom or simulated environment does not guarantee that a learner is competent to perform the activity independently in a workplace.
Learners must apply learning only within:
• Their role
• Their level of training
• Their demonstrated competence
• Their employer’s policies
• Appropriate supervision
• Applicable law and professional requirements
Employers remain responsible for deciding whether a learner requires workplace observation, supervision, competency assessment or further training before carrying out an activity.
Learners must meet the attendance and participation requirements stated for the course.
Depending on the course, learners may be required to:
• Attend the full session
• Arrive on time
• Remain present for the required duration
• Participate in discussions or activities
• Complete knowledge checks
• Complete practical activities
• Complete declarations
• Keep their camera active during virtual training where reasonably required
• Respond to attendance checks, polls or trainer questions
• Complete all parts of a blended course
• Follow reasonable trainer instructions
A learner who arrives late, leaves early, misses a substantial part of the course or fails to participate may:
• Be refused entry
• Be marked absent
• Be required to rebook
• Be referred for further learning
• Be ineligible for certification
Attendance alone does not guarantee a certificate where completion, participation, assessment or practical demonstration is required.
Learners must notify us as early as reasonably possible if they are unable to attend. Cancellation and rescheduling conditions will apply.
Assessment methods vary according to the course and delivery method.
Online learning may include:
• Knowledge checks
• Multiple-choice questions
• Scenario-based questions
• Pass or fail outcomes
• Required completion percentages
• Limited or controlled assessment attempts
Webinar training may include:
• Attendance verification
• Polls or questions
• Learner declarations
• Trainer participation checks
• Post-session assessment
Face-to-face training may include:
• Direct observation
• Practical demonstration
• Verbal questioning
• Scenario assessment
• Trainer review
• Pass or refer outcomes
Blended learning may require successful completion of separate online and practical components before a final certificate is issued.
Learners must complete assessments independently unless group work is explicitly permitted.
Clarivive MedInsight Ltd may withhold, cancel or review an assessment result where there is evidence or reasonable concern relating to:
• Cheating
• Impersonation
• Sharing answers
• Unauthorised assistance
• Manipulation of the LMS
• Fraudulent evidence
• Identity concerns
• Failure to complete required course components
The assessment outcome will be based on the approved criteria for the course and the evidence available to the assessor or system.
Where practical assessment is included, the learner will be assessed against the stated course criteria in a training or simulated environment.
The learner may be required to:
• Follow safety instructions
• Demonstrate required steps in the correct sequence
• Use training equipment appropriately
• Respond to trainer questions
• Repeat a demonstration where permitted
• Show safe and professional behaviour
• Stop an activity where instructed
A pass means that the learner met the required course assessment standard during the observed assessment.
A refer means that the learner did not yet demonstrate the required standard. A refer is not necessarily a permanent failure. The learner may require:
• Additional explanation
• Further study
• More practice
• Reassessment
• Attendance at another session
• Rebooking of the practical component
Reassessment availability, costs and time limits may vary by course.
A practical pass confirms performance during the specific assessment. It does not automatically confirm continuing workplace competence, employer authorisation or ability to undertake the activity without supervision.
A learner may be stopped or referred immediately where their actions create a safety risk.
Learners should notify Clarivive MedInsight Ltd as early as possible if they require a reasonable adjustment or additional support.
Requests may relate to:
• Disability
• Long-term health needs
• Communication requirements
• Mobility needs
• Literacy or language support
• Hearing or visual requirements
• Neurodiversity
• Religious or cultural requirements
• Temporary injury or illness
We may request relevant information to understand the learner’s needs and determine what adjustment is reasonable.
Possible adjustments may include:
• Additional time
• Alternative formats
• Accessible materials
• Seating or venue adjustments
• Rest breaks
• Adapted communication
• Use of suitable assistive technology
• Adjusted assessment arrangements
• Additional trainer explanation
Adjustments must remain:
• Safe
• Reasonable
• Proportionate
• Practically achievable
• Consistent with the essential learning outcomes
• Consistent with valid assessment requirements
An adjustment cannot remove an essential practical skill or lower the required assessment standard.
Where a requested adjustment cannot be provided, we will explain the reason and consider a suitable alternative where reasonably possible.
A certificate is issued only where the learner has satisfied the requirements stated for the course.
Depending on the course, the certificate may confirm:
• Attendance
• Online course completion
• Successful knowledge assessment
• Practical demonstration against course criteria
• Completion of a webinar
• Completion of a blended learning pathway
A certificate does not automatically confirm:
• Workplace competence
• Professional registration
• Fitness to practise
• Employer approval
• Independent-practice authority
• Completion of workplace induction
• Continued competence after the course
• Eligibility for a particular role
Certificates may display:
• Learner name
• Course title
• Completion date
• Expiry or renewal date where applicable
• Certificate number
• Delivery method
• Assessment or completion status
• Provider details
Learners must check that their account details are accurate before certification.
Where a certificate contains an error caused by inaccurate information supplied by the learner, an administration or replacement charge may apply.
We may withhold, revoke or replace a certificate where:
• It was issued in error
• Course requirements were not actually completed
• Fraud, impersonation or malpractice is identified
• The learner’s identity cannot be verified
• A certificate contains a material error
• Payment remains lawfully outstanding
• The certificate has been altered or misused
Any revocation or replacement must be recorded through a controlled process.
Eligible learners may access PDF certificates through the LMS or another approved delivery method.
Certificate availability may depend on:
• Completion of all required course elements
• Successful assessment
• Attendance confirmation
• Trainer submission of the outcome
• Verification of learner information
• Completion of required declarations
• Payment status
• Resolution of any investigation or identity concern
Certificates may remain available through the LMS until:
• The certificate expires
• The learner account is closed
• The certificate is revoked
• The LMS or certificate system is replaced
• The applicable certificate-retention period ends
Learners are responsible for downloading and securely retaining copies where appropriate.
LMS access is not guaranteed indefinitely. Loss of account access does not necessarily mean that the underlying training record has been deleted.
Replacement certificates may be subject to identity checks, record availability and an administration fee where applicable.
Learners must behave respectfully and professionally during all training activities.
Learners must:
• Follow reasonable trainer and venue instructions
• Treat staff and participants with dignity and respect
• Protect confidential information
• Use equipment safely
• Avoid disruptive behaviour
• Respect cultural and personal differences
• Comply with health and safety requirements
• Report relevant safety concerns
• Maintain professional boundaries
Learners must not:
• Threaten, bully, discriminate against or harass others
• Use abusive or offensive language
• Attend while intoxicated or impaired by non-prescribed substances
• Bring prohibited or dangerous items into training
• Deliberately damage equipment or property
• Record a session without permission
• Publish confidential course or participant information
• Cheat or share assessment answers
• Impersonate another learner
• Falsify attendance or assessment evidence
• Alter or misuse a certificate
• Use training sessions to promote unrelated products or services without permission
A learner may be removed from a session where conduct is unsafe, disruptive, unlawful or seriously inappropriate.
Removal for misconduct does not automatically create an entitlement to a refund.
Course materials, assessments, videos, presentations, graphics, trainer content, documents and digital resources remain the intellectual property of Clarivive MedInsight Ltd or the relevant rights holder.
Learners receive a limited, personal and non-transferable right to use course materials for their own learning and lawful professional development.
Learners must not, without written permission:
• Copy substantial parts of course content
• Redistribute training materials
• Publish resources online
• Sell or license materials
• Record or reproduce trainer delivery
• Share restricted LMS content
• Copy assessment questions or answers
• Use content to create competing training products
• Remove ownership or copyright notices
• Use Clarivive MedInsight branding in a misleading manner
Permission to download a resource does not transfer ownership or create a right to republish it.
Unauthorised copying or distribution may result in access restrictions, certificate review, legal action or referral to an employer or relevant organisation where appropriate.

• Booking confirmation
• Course access
• Joining instructions
• Changes to course arrangements
• Attendance
• Assessment
• Certification
• Learner support
• Account security
• Complaints or appeals
• Payments, refunds or cancellations
• Policy or service changes
• Related training information
• Marketing where legally permitted
Essential course and service communications are not marketing messages and may continue even where a learner has opted out of promotional communications.
Learners are responsible for:
• Providing a working email address
• Checking inboxes and spam folders
• Keeping contact details current
• Reading time-sensitive course communications
• Responding where action is required
Our LMS may include internal messaging. LMS messaging must be used appropriately and must not be used to send abusive, unlawful or unnecessary sensitive information.
We are not responsible for missed communications caused by inaccurate contact details supplied by the learner or by the learner’s failure to check messages.
Learner information will be collected, used, shared, secured and retained in accordance with our applicable privacy and data-protection policies.
Records may include:
• Registration details
• Account activity
• Attendance
• Course progress
• Assessment outcomes
• Practical assessment records
• Certificates
• Communications
• Support requests
• Complaints or appeals
• Payment and booking information
• Reasonable-adjustment information
• Investigation or misconduct records
Information may be shared with an employer or booking organisation where training has been arranged or funded by that organisation and sharing is lawful, necessary and proportionate.
Learners may have rights to access, correct, restrict or object to the use of personal information, depending on the circumstances. Personal-data rights are subject to legal conditions and exemptions.

Learners should not submit unnecessary patient-identifiable, medical, financial or confidential information through general forms or LMS messages.
Cancellation, refund, transfer and rescheduling arrangements are governed by the Refund, Cancellation and Rescheduling Policy and any course-specific booking terms.
The applicable outcome may depend on:
• Who made the booking
• Whether the learner is acting as a consumer or through an employer
• The delivery method
• The date of cancellation
• Whether course access has begun
• Whether digital content has been accessed
• Whether a live or practical session has been attended
• Costs already incurred
• Whether an alternative date is available
• Whether the course was cancelled by Clarivive MedInsight Ltd
Learners booking online may have statutory cancellation rights in certain circumstances. Different rules can apply once a learner asks for a service or digital content to begin during a cancellation period. Businesses must provide consumers with prescribed cancellation information for relevant distance contracts.
Any cancellation charge, retained payment or deduction must be handled fairly and must not exceed what is legally justifiable in the circumstances. A business generally cannot retain more than is reasonably required to reflect its direct loss.
Submitting a cancellation or refund request does not automatically mean that it will be approved.
Learners may raise concerns through the applicable:
• Complaints procedure
• Assessment appeals process
• Learner support process
• Reasonable-adjustment review process
• Malpractice or maladministration procedure
A complaint may relate to the quality, administration or delivery of a service.
An appeal may relate to a formal decision, such as:
• An assessment outcome
• A practical refer decision
• Certificate withholding or revocation
• A reasonable-adjustment decision
• A misconduct finding
• An eligibility decision
Requests must normally be submitted within the timeframe stated in the relevant procedure.
Learners should provide:
• Their name and contact details
• Course and booking information
• The decision or issue being challenged
• The reason for the complaint or appeal
• Relevant evidence
• The outcome requested
Submitting an appeal does not automatically change the original decision.
We will aim to consider complaints and appeals fairly, objectively and without disadvantage to a learner who raises a genuine concern in good faith.
Vexatious, abusive, repetitive or knowingly false submissions may be restricted or managed under the applicable procedure.
Clarivive MedInsight Ltd may suspend access, remove a learner from training or terminate enrolment where there is a reasonable and proportionate basis to do so.
Reasons may include:
• Serious or repeated breach of these terms
• Unsafe conduct
• Abuse, harassment or threatening behaviour
• Cheating or assessment malpractice
• Fraud or impersonation
• Certificate misuse
• Unauthorised account sharing
• Security concerns
• Failure to meet eligibility requirements
• Unresolved identity concerns
• Unlawful use of systems or materials
• Non-payment where payment is lawfully due
• Serious disruption to training
• Risk to learners, staff or the public
Where appropriate, we may first:
• Warn the learner
• Request an explanation
• Restrict access temporarily
• Require corrective action
• Investigate the matter
Immediate action may be taken where there is a serious safety, security, fraud or misconduct concern.
Where enrolment is terminated, certification and refund eligibility will depend on the circumstances and the applicable policies. Suspension or termination will not remove any statutory right that the learner may have.
Clarivive MedInsight Ltd is responsible for providing its training services with reasonable care and skill as required by applicable law. The Consumer Rights Act 2015 applies to contracts for services supplied by traders to consumers.
We are not responsible for decisions or actions outside the scope of the training service, including:
• Employer deployment decisions
• Workplace competency sign-off
• Clinical or professional decisions made by the learner
• Failure to follow local policy
• Independent practice undertaken without authority
• Employment decisions
• Regulatory or professional-registration decisions
• Use of training materials for purposes for which they were not designed
• Loss caused by inaccurate information supplied by the learner
• Third-party systems or venues outside our reasonable control
Training does not remove the learner’s responsibility to act within their competence, role, supervision and applicable professional obligations.
Nothing in these terms excludes or limits liability for:
• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Breach of statutory rights that cannot legally be excluded
• Any other liability that the law does not allow us to exclude
Any limitation of liability will apply only to the extent that it is lawful, fair and enforceable.
We may update these Learner Terms and Conditions to reflect changes in:
• Law or regulatory guidance
• Course delivery
• Assessment arrangements
• Certification processes
• Technology or LMS systems
• Security requirements
• Business operations
• Policies and procedures
The latest version will be published with an updated review date.
Changes will normally apply from the date of publication.
Where a learner has already purchased a course, we will not use a later change to remove a right that had already arisen under the original booking, unless the change is required by law or is reasonably necessary for safety, security or regulatory compliance.
Material changes affecting an active learner may also be communicated through email, the LMS or another appropriate method.
These terms are governed by the laws of England and Wales.
The courts of England and Wales will generally have jurisdiction over disputes relating to these terms or the training service.
A consumer who lives elsewhere in the United Kingdom may also have the right to bring proceedings in the part of the United Kingdom where they live.
Nothing in this section removes any mandatory consumer protection or legal right.
Learners and Clarivive MedInsight Ltd should normally attempt to resolve concerns through the complaints or appeals process before beginning legal proceedings, although this does not remove either party’s legal rights.
