Aim of the Course

This course aims to strengthen nurses’ ability to:

1. Obtain and document valid consent
2. Support people to make their own decisions
3. Recognise when capacity may require assessment
4. Apply the statutory capacity test correctly
5. Participate appropriately in best-interests decision-making
6. Recognise valid advance decisions and legal representatives
7. Identify restrictive practices and possible deprivation of liberty
8. Escalate legal, ethical and safeguarding concerns

The course promotes lawful, person-centred practice that protects autonomy, dignity and safety without confusing professional disagreement, risk or cognitive impairment with incapacity.

Scope of the Course

This course is suitable for:

1. Registered adult nurses
2. Mental health nurses
3. Learning disability nurses
4. Children’s nurses working with people aged 16 or over
5. Nursing associates working within their professional scope
6. Care-home and nursing-home nurses
7. Community and primary-care nurses
8. Hospital and urgent-care nurses
9. Clinical educators and practice assessors
10. Senior nurses responsible for consent or capacity processes

The legal focus is the Mental Capacity Act 2005, which applies to people aged 16 or over in England and Wales. Scotland and Northern Ireland have different legal frameworks.

The course does not independently qualify a learner to:

1. Provide legal advice
2. Authorise a deprivation of liberty
3. Make decisions reserved for a court
4. Act as an Independent Mental Capacity Advocate
5. Determine the validity of complex legal documents without appropriate advice
6. Consent on behalf of another adult merely because they are a relative or carer
7. Use restraint or restrictive interventions outside lawful authority and workplace policy

Nurses must follow current legislation, the Mental Capacity Act Code of Practice, relevant case law, professional standards, local consent procedures and organisational escalation pathways.
